Terms of Service

01 Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and Mogcheck LLC ("Mogcheck," "we," "us," or "our") and govern your access to and use of the Mogcheck website, Lab scanner, APIs, and any related features (collectively, the "Service").

By creating an account, starting a scan, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

02 Eligibility and accounts

You must be at least 13 years old to use the Service. Certain features may require you to be 18 or older — those features will say so before you use them. If you are between 13 and 18, you represent that you have a parent or legal guardian's permission to use the Service.

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials confidential and not share them with others.
• Be responsible for all activity that occurs under your account.
• Notify us promptly at security@mogcheck.com if you suspect unauthorized access.

We may refuse, suspend, or close any account at our discretion, including where we believe doing so is necessary to protect the Service or other users.

03 The scan and Lab report

Mogcheck provides on-device facial analysis built on MediaPipe. When you run a scan, your browser uses your device camera to compute facial landmarks and metrics locally; the raw video, frames, mesh, and landmark arrays are not uploaded to or stored by Mogcheck.

The Lab report is for entertainment and self-reflection only. It is not a medical diagnosis, a psychological assessment, a measure of attractiveness in any objective sense, a fitness or health recommendation, or advice of any kind. Do not rely on a Mogcheck Lab report to make medical, surgical, cosmetic, mental-health, dating, employment, or other significant decisions. If you are considering any cosmetic or medical procedure, consult a qualified professional.

Lab reports are generated from a snapshot of measurements taken under your specific lighting, angle, and expression at the time of the scan. Results will vary across scans and should not be treated as a fixed property of you.

04 Guest sessions

You may use parts of the Service as a guest without creating an account. Guest data is stored in your browser and, where necessary for operation, in our database under a temporary identifier. Guest data is intended to be temporary: it can be lost if you clear your browser storage, switch devices, or wait too long, and we may delete it to prevent abuse or to keep the Service reliable. To preserve a session long-term, claim your profile via a supported sign-in method.

05 Acceptable use

You agree not to, and not to assist anyone else to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Submit a scan of anyone other than yourself, or of a minor under 13, or of any person who has not consented to a scan.
• Scrape, harvest, mirror, or otherwise extract data, scoring outputs, model parameters, or analysis pipeline outputs from the Service, including for the purpose of training or building any competing AI or machine-learning model.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, model weights, or underlying algorithms of the Service, except to the extent such restriction is expressly prohibited by applicable law.
• Bypass, disable, or interfere with rate limits, authentication, anti-abuse systems, payment systems, or any other security or access controls.
• Use any bot, scraper, automated tool, or headless browser to access or interact with the Service without our prior written permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service to defame, harass, threaten, dox, or otherwise harm another person.
• Upload or transmit any content that infringes on a third party's intellectual property, privacy, or publicity rights.
• Use the Service to evaluate, rank, classify, or screen candidates for employment, housing, credit, insurance, education, government benefits, or any decision producing legal or similarly significant effects.

Violations may result in immediate suspension or termination, IP-level blocking, and/or legal action.

06 Subscriptions and payments

Some features of the Service may require a paid subscription or one-time payment. Payments are processed by Stripe under Stripe's own terms; Mogcheck does not see, store, or directly process your full card details.

• Billing. Subscriptions renew automatically at the interval and price displayed at checkout until you cancel. By starting a subscription you authorize Mogcheck (via Stripe) to charge your payment method on each renewal date.
• Cancellation. You can cancel any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then.
• Refunds. Except where required by law, payments are non-refundable. We may, at our discretion, issue refunds or credits in cases of clear billing error or extended Service outage.
• Price changes. We may change subscription pricing on renewal. We will notify you in advance, and any new price applies only to billing periods starting after notice.
• Taxes. Prices may exclude applicable taxes, which will be added at checkout where required.

07 User content and feedback

You retain all rights to any content you legitimately submit to the Service (for example, a profile name, an avatar you upload, or feedback you send us). You grant Mogcheck a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, and display that content solely as necessary to operate, secure, and improve the Service.

If you send us suggestions, ideas, or feedback ("Feedback"), you grant Mogcheck an unlimited, perpetual, irrevocable, royalty-free license to use the Feedback for any purpose, without obligation to you.

08 Intellectual property

The Service, including its software, design, brand, scoring methodology, Lab report layout, copy, and all related content, is owned by Mogcheck LLC and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted to you to access and use the Service under these Terms, no rights are transferred to you.

"Mogcheck" and the Mogcheck logo are trademarks of Mogcheck LLC. You may not use them without our prior written permission, except for nominative fair use that does not suggest sponsorship or endorsement.

Third-party libraries used by the Service (including MediaPipe) remain the property of their respective owners and are used under their respective licenses.

09 Third-party services

The Service relies on third-party providers, including Supabase (authentication, database, storage), Stripe (payments), Vercel (hosting and analytics), Google (analytics, sign-in), and Upstash Redis (rate limiting). We list our subprocessors in the Privacy Policy. Your use of the Service is also subject to those providers' own terms where applicable. Mogcheck is not responsible for the practices of third parties beyond our reasonable control.

10 Termination

You may stop using the Service at any time and may delete your account from the Account settings or by emailing privacy@mogcheck.com.

We may suspend or terminate your access — with or without notice — if we believe you have violated these Terms, if your use poses a risk to the Service or other users, or if we are required to do so by law. On termination, your right to use the Service ends; provisions that by their nature should survive (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

11 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT LAB REPORT RESULTS WILL BE ACCURATE, CONSISTENT, OR SUITABLE FOR ANY PURPOSE.

MOGCHECK IS NOT A MEDICAL, COSMETIC, PSYCHOLOGICAL, OR DIAGNOSTIC SERVICE. LAB REPORTS ARE FOR ENTERTAINMENT ONLY AND MUST NOT BE USED TO MAKE HEALTH, MEDICAL, COSMETIC, FINANCIAL, EMPLOYMENT, OR OTHER SIGNIFICANT DECISIONS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

12 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOGCHECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MOGCHECK IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES; THE ABOVE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

13 Indemnification

You agree to defend, indemnify, and hold harmless Mogcheck LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or privacy right.

14 Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section deprives you of any mandatory consumer-protection rights in your country of residence.

15 Dispute resolution and arbitration

Informal resolution first. Before filing any formal claim, you agree to contact us at legal@mogcheck.com and to attempt in good faith to resolve the dispute informally for at least 60 days.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration will be Delaware; the arbitration may be conducted by phone, video, or written submissions as permitted by the rules.

No class actions. You and Mogcheck agree that disputes will be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate claims or preside over any class or representative proceeding.

Exceptions. Either party may bring (a) an individual action in small-claims court, or (b) an action seeking injunctive or equitable relief in court to protect intellectual property rights.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to legal@mogcheck.com within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you are opting out of arbitration.

16 Changes to the terms

We may update these Terms from time to time. Material changes will be announced through the Service or by email. The "Last Updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service and, if applicable, cancel your subscription.
